Refusal to provide password set to become criminal offence in Ireland (irishtimes.com)

What does suspect mean? Is it up to the police officer or up to a judge? Is it the case the police can come to you, grab your phone, ask for your password and assuming you refuse, they put you 5 years in jail? Or is this closer to the police asking a judge to grant permission to compell you to give your password. I guess what I am asking is, is there due process here?
